All content, educational materials, courseware, products, and services made available on www.dakshapath.org ("the Platform" or "DakshaPath") are owned, operated, and managed by DakshaPath Educational Services ("Company", "We" or "Our").

User Account Management

Upon entering this agreement, you understand and confirm that your account credentials ("Username and Password") are exclusively for your individual use. Sharing or allowing others to use your account is strictly prohibited and will result in immediate suspension of platform access, services, and educational content, as well as termination of this agreement.

You accept full responsibility for maintaining the security and confidentiality of your account credentials and all activities conducted through your account. You must immediately inform our Support Team at support@dakshapath.org upon discovering or suspecting unauthorized access to your account. You agree to take all reasonable measures to prevent such unauthorized access and assist us in investigating any security breaches. Under no circumstances will we be held responsible for claims arising from account misuse by unauthorized third parties or your failure to secure your account properly.

Educational Content and Materials

Through our platform services, we provide access to educational content, courseware, assessments, and supplementary materials in various formats including audio, video, text, graphics, recordings, photographs, and digital files related to your enrolled certification programs ("Educational Materials").

We maintain the authority to modify, update, or enhance the educational materials provided to you. Should such modifications occur, additional fees may be required to access updated or enhanced content.

Platform and Service Usage Rights

We provide you with a personal, limited, non-transferable, non-exclusive, and revocable license to access the platform, services, and educational materials until completion of your enrolled training program or termination of this agreement, whichever occurs first. These services and materials are intended solely for your personal, non-commercial educational purposes.

You may access the platform and educational materials online and are permitted to download, save, or print materials exclusively for personal, non-commercial educational use.

You are prohibited from reproducing, distributing, transmitting, sublicensing, broadcasting, sharing, or creating derivative works from the educational materials, in whole or in part, through any medium or channel for purposes beyond personal use, without our explicit written authorization.

Personal Information Usage

We reserve the right to include your photograph in promotional materials, videos, or marketing content. Additionally, we may use your personal information to notify you about additional training opportunities we offer. However, we will not sell or share your personal information with third-party marketing databases or disclose it to external parties, except after proper verification or when legally required.

Communication and Marketing Consent

By registering on www.dakshapath.org, you authorize us to contact you through email, text messages, or phone calls to deliver services, share educational content, send promotional offers (including partner offers), and fulfill service requirements. This consent remains valid even if your number is registered under Do Not Disturb services, in compliance with telecommunications regulations. You may revoke this consent anytime by contacting us or using unsubscribe options in our communications.

During enrollment, we collect your first name, last name, phone number, email address, country, city, birth date, and gender information. DakshaPath may also obtain information from business partners. This data enables us to provide customized services and communications. Registration also authorizes us to send notifications regarding account details, service updates, and promotional content. You can opt out of non-essential communications at any time.

Liability Limitations

You explicitly acknowledge that platform usage, services, and educational materials access are at your own risk. We do not guarantee uninterrupted or error-free platform operation, service delivery, or content access. No warranties are provided regarding results from platform usage or accuracy of information provided through our services or educational materials.

This liability disclaimer covers all damages or injuries resulting from performance failures, errors, omissions, interruptions, deletions, defects, operational delays, computer viruses, communication failures, theft, destruction, unauthorized access, alteration, or record misuse, whether due to contract breach, negligence, or other legal causes.

You specifically acknowledge that we are not liable for defamatory, offensive, unlawful, or inappropriate conduct by third parties or other platform users, and you assume all risks associated with such exposure.

You agree that our liability, including that of our affiliates, directors, officers, employees, agents, and licensors, arising from any legal claim (contractual, tort, or otherwise) related to services or educational materials will not exceed the fees you paid for your specific training program.

Agreement Duration and Termination

This agreement becomes effective upon your acceptance by clicking "I AGREE" and remains valid while you maintain an active, paid user account or until we terminate it, whichever occurs first.

We reserve the right to terminate this agreement and immediately block access to educational materials by providing written email notification ("Immediate Termination"), particularly when termination results from misrepresentation, default, misconduct, or breach of agreement obligations ("Default Event").

Modifications and Transfer Rights

We retain the authority to unilaterally modify this agreement without prior notice. However, revised agreements will be published on the platform to inform you of changes. You acknowledge responsibility for periodically reviewing the platform for updates, modifications, and amendments. Continued platform usage or access following posted changes constitutes acceptance of those modifications.

You cannot assign this agreement or its associated rights and obligations to any third party and remain solely liable for any agreement breaches or violations.

Legal Jurisdiction and Governing Law

These Terms and Conditions are governed by Indian law. Any disputes related to these terms or platform usage fall under the exclusive jurisdiction of courts in Pune, Maharashtra, India.
